These Terms of Purchase (“Terms”) govern your purchase of innovative outdoor products (“Products”) from cotopaxd (“we,” “us,” or “our”) through our website (www.cotopaxd.com, “Website”). By placing an order on our Website, you (“you” or “customer”) acknowledge that you have read, understood, and agreed to be bound by these Terms, as well as our Privacy Policy, Shipping Policy, and Refund Policy (incorporated herein by reference).
1. Acceptance of Orders
1.1 Order Placement
When you place an order on our Website, you submit a binding offer to purchase the Products selected. All orders are subject to our acceptance, and we reserve the right to reject or cancel any order for any reason, including but not limited to:
- Incorrect Product pricing or description due to typographical errors or system malfunctions.
- Unavailability of Products (e.g., stock shortages, discontinuations).
- Suspected fraudulent activity (e.g., unauthorized payment methods, fake shipping addresses).
1.2 Order Confirmation
We will send an order confirmation email to the email address provided at checkout immediately after you submit your order. This email confirms that we have received your order but does not constitute acceptance. Acceptance of your order occurs only when we dispatch the Products and send a shipping confirmation email (with a tracking number). At this point, a binding contract between you and cotopaxd is formed.
2. Pricing & Payment
2.1 Pricing
All Product prices on our Website are quoted in United States Dollars (USD) and include applicable sales taxes for orders shipped to locations where we are legally required to collect them. Prices are subject to change without notice, but we will honor the price listed at the time you place your order (provided the order is accepted).
2.2 Payment Methods
We accept the following payment methods:
- Major credit/debit cards (Visa, Mastercard, American Express, Discover).
- Digital wallets (PayPal, Apple Pay, Google Pay).
By providing payment information, you represent and warrant that:
- You are authorized to use the payment method.
- The payment information is accurate and complete.
We do not store full credit/debit card details—all payment processing is handled by secure, third-party payment service providers (e.g., Stripe, PayPal) that comply with the Payment Card Industry Data Security Standard (PCI DSS).
2.3 Payment Authorization
We will authorize your payment method at the time of order placement to verify funds availability. Charging will occur when we dispatch the Products (i.e., upon order acceptance). If payment is declined, we will notify you via email, and your order will not be processed until payment is successfully completed.
3. Shipping & Delivery
3.1 Order Processing & Dispatch
We will process and dispatch your order within 1–3 business days (Monday–Friday, excluding major holidays). For custom or personalized Products, processing may take up to 3 business days (we will notify you of any delays via email).
3.2 Delivery Timelines
All orders (domestic and international) are delivered within 6–12 business days from the date of dispatch. Delivery timelines are estimates and may be affected by factors beyond our control, including customs processing (for international orders), weather conditions, or carrier delays.
3.3 Shipping Costs
We offer free global shipping on all orders, with no minimum purchase requirement. There are no hidden fees for shipping—all delivery costs are covered by cotopaxd.
4. Returns & Refunds
4.1 Return Eligibility
You may return eligible Products for a refund within 60 days of delivery, provided:
- Products are in unused, original condition with all tags, packaging, manuals, and accessories intact.
- Products are not custom/personalized, final sale, or hygiene-related items (e.g., sleeping bags, first-aid kits), unless they arrive damaged or defective.
4.2 Return Process
To initiate a return:
- Email our customer service team at [email protected] with your order number, the Product(s) to be returned, and the reason for the return.
- We will respond with a prepaid return shipping label and detailed return instructions within 2 business days.
- Ship the Product(s) back to us using the provided label within 7 business days of receiving approval.
4.3 Refund Processing
Once we receive and inspect the returned Product(s) (typically 3–5 business days after delivery to our warehouse), we will process your refund. Refunds are issued to the original payment method within 5–10 business days of inspection.
Note: Shipping costs for returns are covered by cotopaxd. We do not charge restocking fees for eligible returns.
5. Title & Risk of Loss
Title to the Products passes to you upon delivery. The risk of loss or damage to the Products passes to you once the carrier delivers the Products to the shipping address provided at checkout. If your order is lost or damaged during transit, please contact us at [email protected] within 3 days of the expected delivery date to initiate a claim (see our Shipping Policy for details).
6. Product Availability & Backorders
We strive to maintain accurate stock levels on our Website, but occasionally Products may be out of stock after an order is placed. If a Product is unavailable (e.g., due to unexpected stock shortages), we will:
- Notify you via email within 2 business days.
- Offer you the option to either wait for the Product to be restocked (with an estimated restock date) or cancel your order for a full refund.
If you choose to wait for restocking, we will dispatch the Product as soon as it becomes available, and delivery will still occur within 6–12 business days of dispatch.
7. Limitation of Liability
To the maximum extent permitted by law, cotopaxd shall not be liable for any indirect, incidental, consequential, or special damages arising out of or in connection with your purchase or use of the Products, including but not limited to lost profits, lost data, or inconvenience due to delivery delays.
Our total liability for any claim arising from your purchase shall not exceed the total amount paid for the Products in question. This limitation does not apply to damages caused by our gross negligence, willful misconduct, or breach of statutory obligations (e.g., product safety laws).
8. Product Descriptions
We make reasonable efforts to ensure that Product descriptions, images, and specifications on our Website are accurate and up-to-date. However, we do not warrant that descriptions or images are error-free, and slight variations in color, size, or design may occur due to manufacturing processes or screen resolution differences. 9. Governing Law & Disputes
These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of laws principles.
Any dispute arising out of or relating to these Terms or your purchase shall first be resolved through good-faith negotiation with our customer service team (via [email protected]). If negotiation fails, the dispute shall be submitted to binding arbitration in Los Angeles, California, in accordance with the rules of the American Arbitration Association (AAA). Arbitration awards are final and binding and may be enforced in any court of competent jurisdiction.

We may update these Terms from time to time to reflect changes in our business practices, legal requirements, or industry standards.
